Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Design Show Inc. ("Zacai," "we," "us") governing your use of the Zacai platform at zacai.org and any associated mobile applications ("Service").

By creating an account or accessing the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Age Requirements

• The Service is designed for learners ages 3 and older.
• Learners ages 3–18: A parent or guardian must review these Terms and our Privacy Policy and give consent before the account opens. COPPA additionally requires verified parental consent for users under 13.
• Users 19 and older may register for themselves.

3. Accounts

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when registering.
• You may not share your account with others unless you are on a Teams plan.
• Notify us immediately via the support form if you suspect unauthorized access to your account.

4. Subscription Plans and Billing

• Free trial: Signup creates a free Starter account. Paid plans include a 7-day trial before billing. You are not charged until those 7 days end. Billing terms are on this page.
• Subscriptions renew automatically at the end of each billing period until cancelled.
• You may cancel at any time from Account. Cancellation takes effect at the end of the current paid period; no partial-period refunds are issued. Refund questions go through /refund or the support form.
• All prices are in USD. Tax may apply depending on your jurisdiction.
• Mobile purchases: Subscriptions purchased through the Apple App Store or Google Play are governed by those platforms' billing policies. Cancellation must be managed through the respective platform.

5. AI Tutor

Zacai may include an AI-powered tutor ("Zacai AI") for educational support within the curriculum. The tutor is not available yet. Daily, monthly, and global spend ceilings apply. When the tutor is offered, tutor text does not grade lessons or award completion, XP, or mastery.

• Do not share personally identifiable information, passwords, or sensitive data in tutor conversations.
• AI responses are generated automatically and may occasionally be inaccurate. Always verify important information with authoritative sources.
• The tutor applies age-appropriate content filters based on your registered age band.
• Misuse of the AI tutor to generate harmful, inappropriate, or off-topic content is prohibited and may result in account suspension.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent age verification, parental consent, or subscription gating
• Scrape, harvest, or copy course content in bulk
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Impersonate another user or provide false registration information
• Upload or transmit malicious code, spam, or abusive content
• Harass, bully, or harm other users

Violations may result in immediate account suspension or termination without refund.

7. Intellectual Property

All platform content — curriculum, lesson materials, UI design, and trademarks — is owned by Design Show Inc. or its licensors. You receive a limited, non-exclusive, non-transferable license to access and use the Service for personal educational purposes during an active subscription.

You may not copy, distribute, sell, or create derivative works from any Zacai content without prior written permission.

8. Account Deletion

You may delete your account at any time from Account. Deletion permanently removes your profile, learning progress, and personal data within 30 days, subject to our Privacy Policy. Active subscriptions should be cancelled before deletion to avoid further charges.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free. Educational outcomes depend on each learner's effort and engagement.

To the fullest extent permitted by law, Design Show Inc. is not liable for indirect, incidental, or consequential damages arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any dispute arising under these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in English.

11. Changes

We may update these Terms from time to time. Material changes will be emailed to registered users at least 14 days before taking effect. Continued use after that date constitutes acceptance.
